Terms & Conditions of Sale

 

Please read these terms and conditions of sale carefully as they contain terms which will be binding upon you when you place an order with us.

These are the Standard Conditions of Sale for all products shown on the pages of this website.

1 About us

This website is presented by Champagnes-Ecosse Ltd (also referred to as "we" or "us"). If you have any comments or questions about this website or any aspect of our services please contact us using the information on the 'Contact Us' page of this website.

2 Privacy and Security

Your privacy is important to you and to us. Please see our Privacy and Security Policy for information about what information we collect and how we will use and protect it.

3 Order

3.1 Visitors under the age of 18 must not order, or try to order, any product containing alcohol.
3.2 By placing an order with us you are making an offer which, if accepted by us, will constitute a binding agreement between us.
3.3 You are responsible for ensuring the accuracy of any order you submit.
3.4 No order shall be deemed to be accepted by us unless and until it is confirmed by us by email or in writing and payment has been taken from your payment card. We reserve the right to decline any order.
3.5 Any advice or recommendation given on this website or otherwise given to you by us, or any of our employees or agents, is followed by you or acted upon by you entirely at your own risk and, accordingly, we shall not be liable for such advice or recommendation.

4 Product  availability and descriptions

4.1 We take care to ensure that all product information and pricing featured on this website is accurate and up-to-date. However, our products and services are continually updated and accordingly images, specifications and prices may change. The representation of colours on your browser may vary from the actual colours.

4.2 All Goods are subject to availability. In the event that your chosen Goods are not available we will:
(a) notify you and no payment will be taken; or
(b) if we have already taken payment from your card, notify you and credit your card with the sum that we have taken.

5 Errors

Any typographical, clerical or other error or omission on any page of this website shall be subject to correction without any liability on our part.

6 Price

6.1 The price of the Goods will be the price set out on the relevant page of this website.
6.2 We reserve the right to change the prices at any time. However, if we accept an order from you, the price for the Goods will be the price set out on the relevant page at the time the order for them is placed.
6.3 Prices for Goods on this website are shown in £ sterling (GBP) and are exclusive of
UK VAT at the prevailing rate.
6.4 If a price has been incorrectly entered by us on the website, by an administrative, clerical, typographical or other error, we retain the right not to sell the products at the incorrect price.

7 Payment Method

7.1 Upon providing the details of your payment card and submitting an order, you confirm that you are authorised to use the payment card to pay for Goods and authorise us to deduct from the payment card the full price of the Goods and all other payments due such as delivery charges.
7.2 Where Goods are returned to us in accordance with these terms, we will credit the payment card with the appropriate amount.

8 Delivery

8.1 The Goods will be delivered to the delivery address entered on your order form. Items ordered together might not be dispatched together.
8.2 The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. The first and second delivery attempts will be free of charge within the
UK. All subsequent delivery attempts will be chargeable at a rate set out by our courier company(s) plus 10% for administrative charges.
8.3 They buyer can, at their own risk, ask for good to be 'left safe'. In this event, if no one is available to receive the goods, they will be left safe. The driver's signature that the goods have been delivered will constitute proof of delivery.
8.3 Goods ordered on one working day shall normally be dispatched on the next working day for delivery on the subsequent working day. Whilst every effort is made to deliver the Goods in accordance with the timescales set out, we do not accept any liability for late delivery of the Goods and this shall not entitle either party to treat this contract as repudiated.
8.4 The risk in the goods shall pass to you upon delivery taking place.
8.5 Upon receiving notice that goods have been lost or damaged in transit we shall replace the same free of charge. Where goods have been damaged or lost in transit delivery shall not be deemed to have taken place until replacement goods have been delivered by us to you.
8.6 Goods are delivered free of charge on working days within the
UK. Deliveries outside of the UK and/or on Saturdays, Sundays or Bank Holidays must be arranged with us and will incur additional charges. Deliveries to the Highlands, Scotland's Islands, Channel Islands, Isle of Man, Northern Ireland and certain postal codes outside of England & Wales may unfortunately be subject to delays and may not arrive on the next working day; details of which postal codes are affected are available upon request.

9 Acceptance of the Goods and Refunds

9.1 You shall be deemed to have accepted the goods upon delivery to you.
9.2 After acceptance you shall only be entitled to reject the goods in accordance with this agreement.
9.3 If you properly reject any of the products which are not in accordance with the contract you shall nonetheless pay the full price for such goods unless you promptly give notice of rejection to us and return the goods to us.
9.4 No goods delivered to you that are in accordance with the contract will be accepted for return without our prior written approval on terms to be determined at our absolute discretion.
9.5 Goods returned to us without our prior written approval may at our absolute discretion be returned to you at cost without prejudice to any rights or remedies we may have.
9.6 Upon receipt of properly rejected goods returned to us, we will issue a full refund.

10 Cancellation and returns

10.1 You may cancel your order 24 hours before the delivery date. Orders cancelled will be subject to a 10% cancellation fee.
10.2 You are not entitled to cancel orders for Goods that have been used or damaged after delivery or for Goods personalized at your request unless the Goods were faulty when delivered. We will not be responsible for returned Goods that are lost or damaged in transit.
10.3 The right to cancel your order does not apply in respect of any
Champagne or accessories which have been opened after receipt.

11 Liability

11.1 Any claim by you which is based on any defect in the quality or condition of the Goods or their failure to correspond with the description must be notified to us within 48 hours from the date of delivery (by one of the methods set out in paragraph 1 above) or, where the defect or failure was not apparent on reasonable inspection, within a reasonable time after discovery of the defect or failure. If you do not notify us within the required timescales, you shall not be entitled to reject the Goods and we will have no liability for such defect or failure.
11.2 In the event of a valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods is notified to us in accordance with these terms and conditions, we will be entitled to replace the Goods free of charge or, at our sole discretion, refund to you the price of the Goods but we will have no further liability to you.
11.3 We shall not be liable for any loss or damage, in contract, negligence or otherwise, where:
(a) there is no breach of a legal duty of care owed to you by us;
(b) the loss or damage is not a reasonably foreseeable result of any such breach;
Or
(c) any increase in loss or damage results from a breach by you of these terms.
11.4 Nothing in these terms and conditions excludes or limits our liability for fraud or for death or personal injury caused by our negligence.
11.5 Your statutory rights are not affected by these terms.

 

12 Data Protection

If you place an order with Champagnes Ecosse Ltd we will record your personal details. Your data will be used principally to provide you with the goods and/or services you have purchased. We retain the data you provide from time to time, including data we collect when you place an order or use our products and services. Your data may be used for the following purposes: accounting, billing and audit, credit or other payment card verification, security, administrative and legal purposes, customer relations and to help us in any future dealings with you. For these purposes we may disclose your data to any of the following: other companies involved in providing you with the goods and/or services you have ordered (including our logistics providers and customer service agents), data processing companies, our technology suppliers, government and enforcement agencies and credit and charge card companies. Please refer to our Privacy and Security Policy for further information.

13 Variation

We reserve the right to change these Terms and Conditions at any time. The new version will be posted on the website and will take effect and govern new orders immediately upon posting. If you place a new order after the new Terms and Conditions have come into effect this will indicate your agreement to be bound by the new Terms and Conditions.

14 Governing law

These terms and conditions shall be subject to Scot’s law and the parties hereby submit to the non - exclusive jurisdiction of Scottish courts.
